Q: What are my voting rights in the condominium association?
A: Each unit is entitled to cast one vote in the Seascape Homeowners Association, Inc. Each unit has limited voting rights in accordance with the requirements of Sections 5.3 and 5.4 of the Seascape Declaration of Covenants Re: Assessments, as amended, which state that the Class B Member is vested with sole voting rights until the Class B membership terminates, and thereafter when entitled to vote, each owner of a Unit shall have one vote for each Unit owned.
Q: What restrictions exist on my right to use my unit?
A: No unit may be used other than residential purposes, except those units specifically designated as commercial units. No unit owner may dispose of his unit except in accordance with Section 11 of the Declaration of Condominium. There are various restrictions on the use of your unit, and these are set forth in detail in Section 10 of the Declaration of Condominium. Other covenants related to the Seascape project as a whole are contained in the Seascape Declaration of Covenants Re: Assessments, Exhibit P (11) to the Prospectus.
Q: What restrictions exist on the leasing of my unit?
A: None, except that unit, may only be leased for residential purposes and for a period of one day or more.
Q: Do I have to be a member of any other association? If so, what is the name of the association and what are my voting rights in the association?
A: As described above, you will be a member of both the Ariel Dunes Association and Seascape Homeowners Association. Your voting rights and assessments are described above and are further described in the exhibits to the Declaration of Condominium and in the Prospectus.
Q: Am I required to pay rent or land use fees for recreational or other commonly used facilities?
A: As a member of the associations, you will pay a share of the expenses for maintaining, managing, and replacing certain community property such as roads, pedestrian access, swimming pools, tennis courts, and landscaping throughout the development. Use of tennis courts, golf course, and beach setups are not included in assessment dues.
Q: Is the condominium association or other mandatory membership association involved in any court cases in which it may face liability in excess of $100,000? If so, identify each such case.
A: None
Q: Are there any other representations as described by the Florida Condominium Act that is required to assist the purchaser in deciding whether to purchase a condominium unit?
A: None.
Q: How much are my assessments to Ariel Dunes Condominium Owners Association and the Seascape Homeowners Association for my unit type?
A: There are several residential unit types in Ariel Dunes, all of which have different assessment obligations.
With regard to Ariel Dunes Condominium Owners Association, the assessments are due monthly or annually, and are determined on the basis of the relative square footage of each unit as follows:
